Terms of Service for Gallery

Welcome to Nothing Gallery! These Terms of Service for Nothing Gallery (“Terms”) govern the relationship between you and Nothing Technology Limited (“Nothing”) with respect to our gallery services (“Gallery” or “Services”). By accessing or using our Services, you agree to accept (1) the EULA, (2) these Terms; and (3) Nothing's Privacy Policy. Please read the following terms and conditions carefully before using the Services and confirm your agreement to comply with these Terms.

1. Gallery Services
Gallery utilizes on-device capabilities to provide a personalized experience, allowing you to view, share, manage, and perform operations on your photos and videos efficiently. You can perform a basic search for photos or videos stored on your device based on the time and location of their capture. We do not access your photos or videos, and do not use them for research and development.

2. Sharing Photos
Gallery puts you in control of what you share with other users, or to third-party apps. When using Gallery, you can select the photo or video you want to share or grant the app access to your entire Gallery. Access to photos includes associated data, such as location and depth information. You can change an app's ability to access your Gallery at any time by going to Settings > Apps.

3. Location
If you allow Gallery to access your location, your location will be used to tag where photos and videos are taken. You can change this setting at any time by going to Settings > Location > App location permissions. You can also adjust the location switch before taking a photo or video directly in the camera by tapping More Setting, then tapping Save Location to turn it off or on. If location is turned off, the location information will not be stored in photos and videos details.

4. User Responsibility
You are solely responsible for your photo and video and the consequences of sharing it. You agree not to use Gallery for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Services.

5. Intellectual Property
All content and materials related to Gallery, including but not limited to icons, graphics, logos, and software, are the property of NOTHING or its licensors and are protected by intellectual property laws. You may not use, reproduce, modify, or distribute any such content without our express written permission.

6. Disclaimers
Gallery is provided "as is" and "as available" without any warranties of any kind, whether express or implied. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components. Your use of the Services is at your own risk.

7. Updates and Termination
Nothing reserves the right to update, change, terminate or suspend the Services and the Terms at any time without prior notice. Any updates shall become effective immediately upon publication.

8. Liability
Nothing shall not be liable for any direct, indirect, consequential, special, punitive, or exemplary damages arising from or relating to the Services, regardless of the theory of liability.

9. Governing Law
Unless your jurisdiction requires mandatory application of local law, these Terms shall be governed by the laws of England and Wales, without regard to conflict of law provisions. The courts of London shall have exclusive jurisdiction.

10. Other Terms
a. These Terms constitute the entire agreement between you and us regarding the Services and supersede any prior or contemporaneous oral or written agreements.
b. If any provision of these additional service terms is deemed invalid or unenforceable, that provision shall be deemed divisible and shall not affect the validity and enforceability of the remaining provisions.
c. The Services and other Nothing technology may be subject to export control laws and regulations. You acknowledge and agree that you shall not export or re-export any content in contravention of such laws and regulations. You represent and warrant that you are not subject to any blacklists or sanctions of relevant countries, including, without limitation, the United States, the United Kingdom, and the European Union.
d. A person who is not a party to these Terms shall not have any rights under or in connection with it by virtue of the Contracts (Rights of Third Parties) Act 1999.
e. No provision of these Terms may be waived except by a writing executed by the party against whom the waiver is to be effective.
f. Nothing's failure to enforce any provision of these Terms shall neither be construed as a waiver of the provision nor prevent Nothing from enforcing any other provision of these Terms.
g. Your relationship with Nothing shall be on a principal-to-principal basis and nothing in these Terms will be construed as creating an agency, partnership, joint venture, association of persons or employment relationship between you and Nothing.

By using the Services, you acknowledge that you have read these Terms and agree to be bound by them.
